Terms of Use for Lulucat Flow

These Terms of Use apply only to Lulucat Flow. They are an agreement between the user and GOODWRITE LIMITED and supplement Apple's Standard Licensed Application End User License Agreement.

Agreement and scope

By downloading or using Lulucat Flow, the user agrees to these Terms. These Terms do not apply to any other Lulucat product or service; each product has its own terms. Lulucat Flow is licensed, not sold.

Apple Standard EULA

The download and use of Lulucat Flow are governed by Apple's Standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms add provisions specific to Lulucat Flow. If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA controls.

Licence and purchase

Downloading Lulucat Flow grants the licence described in the Apple Standard EULA, subject to Apple's Usage Rules. The optional one-time in-app purchase removes the five-minute limit for an individual recording on devices permitted by Apple. It does not transfer ownership of the app and does not create a separate licence. There is no subscription or recurring charge.

Recordings and other content

As between the user and GOODWRITE LIMITED, GOODWRITE LIMITED claims no ownership of content recorded with Lulucat Flow. This statement does not grant the user any right in material that the user does not otherwise have the right to record or use. The user is solely responsible for obtaining all permissions required to record, store, edit, disclose or distribute any person, conversation, performance, work or other material. Some jurisdictions require the consent of every participant before a conversation or call may be recorded.

Prohibited use

The user must not use Lulucat Flow for unlawful surveillance, to intercept communications without lawful authority, to infringe privacy, confidentiality, intellectual-property or other rights, or in any other manner prohibited by applicable law.

Recording reliability

Recording depends on the Mac, connected devices, available storage, macOS permissions and third-party hardware and software. To the maximum extent permitted by law, Lulucat Flow is provided on an “as is” and “as available” basis without a guarantee that every recording will complete successfully or be free from interruption, corruption or loss. The user must verify recorded files before relying on them and is responsible for maintaining appropriate backups.

Statutory rights

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, warranty, condition, right or remedy that cannot lawfully be excluded, including rights under applicable European Union, United Kingdom and Australian consumer law. Where liability may be limited but not excluded, it is limited only to the extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, GOODWRITE LIMITED is not liable for indirect, incidental, special or consequential loss, or for lost recordings, lost work, lost time, loss of data or loss of profit. GOODWRITE LIMITED's aggregate liability arising from Lulucat Flow will not exceed the greater of US$50 and the amount paid by the user for Lulucat Flow. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, wilful misconduct or any liability that cannot lawfully be limited.

Refunds

App Store purchases and refund requests are administered by Apple. A refund may be requested at https://reportaproblem.apple.com/. This section does not restrict any statutory right to a refund, withdrawal, repair, replacement or other remedy.

Termination

The licence terminates automatically if the user materially breaches these Terms and does not remedy the breach where a remedy is possible. On termination, the user must stop using and delete Lulucat Flow. Termination does not affect ownership of existing recordings, rights that arose before termination or any statutory right.

Disputes

Nothing in these Terms limits any right to bring a dispute before a court or tribunal that has jurisdiction under applicable law. If the user is a consumer, the user retains all mandatory protections and forums available under the law of the user's country of residence.

Changes and severability

GOODWRITE LIMITED may update these Terms for legal, security or product reasons. A revised version will be published on this page with a new effective date. A material change will take effect no earlier than 30 days after publication unless applicable law or an urgent security requirement requires earlier effect, and it will not apply retroactively. If any provision is held unenforceable, the remaining provisions remain in effect and the affected provision applies to the greatest extent permitted by law.
